Terms and Conditions:

 

A booking is confirmed after the payment of the deposit and satisfactory completion of the Booking Application form. Payment of the deposit by the hirer acknowledges acceptance of the outlined terms and conditions.

 

Cancellation:

Tutukaka Boat Hire Ltd reserves the right to cancel hire bookings due to poor weather/sea conditions or unforeseen situations beyond its control. Should a booking be cancelled for these reasons Tutukaka Boat Hire Ltd will make every effort to rebook at a suitable date, or if a suitable date cannot be found will refund the booking deposit in full.

Should at any time during the hire period, it be deemed by Tutukaka Boat Hire Ltd that the weather/sea conditions have deteriorated to an extent that the boat, occupants or third parties are endangered, or that the actions of the skipper are illegal or endangering the boat, occupants or third parties, Tutukaka Boat Hire Ltd reserves the right to recall the boat to a safe location or terminate the hire. In the event of weather deterioration, a refund will be given in proportion to the total time of the hire.

Should a hirer cancel a booking less than 15 days prior to the hire date, a $100 cancellation fee will be deducted from the deposit returned to the hirer.

 

Insurance:

A security bond of $500 is required prior to commencement of the hire period. The bond is refundable on return of the boat provided it is returned in a condition satisfactory to Tutukaka Boat Hire Ltd.

All boats are fully insured including third party liability. If during the hire period, damage or loss occurs, the hirer is liable:

a) To pay full insurance excess of $1,000.00

b) To pay the full costs of damage or loss in the event that the insurance company declines the claim.

Loss of or damage to hire fishing rods, water skis and ski biscuit are not covered by insurance. Tutukaka Boat Hire Ltd reserves the right to deduct from the bond or charge hirers for any loss or damage to these items.

 

General:

 

The Hirer must listen regularly to weather reports and take due care in the use of the boat. The safety of passengers and the boat is the responsibility of the Hirer during the hire period.

 

The skipper must be at least 20 years of age. Photo ID is required. The boat must be under the control of the skipper at all times.

 

The boat must remain in the designated survey area at all times with no more than 6 people aboard.

 

Hire hours are approximately 7.30am to 5.30pm. By agreement this can be varied depending on time of year. In accordance with the conditions of the MSA survey the boat is not permitted to be operated during the hours of darkness unless in an emergency.

 

The hirer and everyone on board must adhere to current M.A.F. fishing regulations and the Maritime rules and regulations applying in the boating area. Copies of the Fishing Regulations are contained in the boat’s onboard documentation and fish measurers are provided.

 

Should any breach of the above conditions or regulations occur resulting in fines or confiscation of the boat, the hirer is solely responsible for meeting any fines or costs.

 

If the boat is to be anchored at any time of the hire period for the purpose of coming ashore it must be anchored in a secure manner and in view at all times of the hirer. The boat is not to be beached at any time.

 

The skipper will not consume alcohol or any judgement impairing substance during the hire period.

 

All rubbish is to be returned to shore for suitable disposal.
